We've seen this time and again. Once cracks start to show in the exterior they get wider and wider and more poison just seeps out. Hang on to your hats my Republican friends, something's got to change or you've all got a big shock coming in Nov. '08. I know you don't believe it because you aren't conditioned to thinking that way, but I'm telling you it's not good.

While there is a part of me that takes some joy in being vindicated, there's another part of me that's sad that the disease of corruption is really this bad.

Real Estate and other sites, I see what look like incredible deals on Forclosed Homes, but the information is very limited. I'd be a first time home buyer and so I know little about the home buying process in general, but what would be the best way to go about getting more thorough information on these houses!? Are the deals you can get on a foreclosure really as good as they let on?

If it were me and this being your first real estate purchase I would employee the services of a Real Estate Agent. Foreclosure are purchased no differently than a independent sale except the bank is the owner making the decision. When buying a foreclosure it is important to make sure he condition of the property is equal to the value. Just because it is a foreclosure does not make it a good deal. The agent could value the property for you. The one thing people forget or maybe they don't know is that a Real Estate Agent is paid by the sell not the buyer. It is in the buyers best interested to have a Real Estate Agent as there representation when buying. Contact and agent in your area that can help you with this. There is a case named Blynn v. Seven Unknown Agents (Supreme Court case; I don't remember the site), in which Mr. Blynn's house was broken into by the police without a warrant; Mr. Blynn was stripped and searched before his family, without reasonable suspicion; Mr. Blynn's house was searched, without a warrant; and Mr. Blynn was arrested and jailed, without probable cause.





Mr. Blynn sued the government agents, In Pro Per, and took it to the Supreme Court.





The Supreme Court determined that Mr. Blynn had the right to sue the agents, despite the fact the agents were acting under the ';color of authority,'; due to the fact that the agents violated their powers to act under the color of authority.





So, under this decision, you can sue the police for acting beyond the scope of their authority; but, you need to prove this in court, as well as what damages were actually suffered.





Talk to an attorney about this, if you have quantifiabl damages.

You could try if they didn't have a search warrant, however, they will just find a ';probable cause'; explanation. Then they will harass you endlessly.
If the police had a Search Warrant or you let them come in to do the search, you may have less reason to sue.
You cannot sue the police for anything they do in the process of their official duty, unless they violate your civil rights or you can prove malicious prosecution, which is quite difficult. They should have shown you a warrant as they commenced the search which gave the reasons for the search. If they had reasonable cause to search, which is basically taken as a given if the warrant was signed by a judge, they did nothing wrong and you have no recourse other than perhaps filing a complaint with the department.

    I dont know. I was of the opinion that your wife/husband should be your love, your lover, your confidante and your best friend. Maybe I am wrong.     i would wait on giving them names..my cats when i got them where 5 months old and their names changed like 3 times..i waited until their personalities really started to come out..one is shadow cause he follows me around every where..where ever i walk to 2 sec later there he is..and the other is tiger cause he is bigger then his brother..has really big paws and when he walks it looks like he is stalking..their names totally fit their personalites now..so i would give it some times before giving them names..until now cutie kitty or hunny boo.. lol';pet names'; should do for...enjoy!!!

The difference in them is usually the style of the home, what they're offering (some include new appliances), some build in the better areas because they have the high ceilings and expansive homes.

    There are all types of fireplaces that fit all kinds of needs. Several that don't need a chimney. I would suggest going to a fireplace/grill store, and ask them what your options are.

    First and foremost, you need a way to support yourself and keep the lights on. A lot of professional writers do so on the side because what they make is not enough to live on.


    Maybe you can do secretarial work from home, or proofreading, or find work of some kind that allows you to earn a living while keeping your dignity, and giving you the time to write, without having to depend on selling everything you write just to survive.

    No, the only laws that govern what Realtor you can or can't use are contract laws. Since you haven't signed a contract with your current Realtor you can change at any time. Two things to remember are that if you decide to purchase a home your original Realtor has worked to show you, you should use them as they may attempt to collect a commission from you if you don't (most don't have a legal case, but if you think the Realtor would be competent no reason to but yourself in the possible situation.) Second please notify the first Realtor of your decision. We put a lot of work into home searches in most cases and we appreciate knowing that we will no longer be paid for our work rather than a potential client just breaking off contact and a Realtor spending hours trying to reestablish contact.Are there any laws in Texas preventing a buyer from changing realtors during a home search?
    In fact, if you don't have a contract with that Realtor, they are actually representing the seller not you. Not only can you use another Realtor, but you can use several at the same time.





    Have you talked to a mortgage company to try and get pre-approved for a mortgage?
    Do you have a signed buyer broker agreement? If not you can ';fire'; your real estate agent. In most states that is how it works and usually a buyer-broker agreement has a very limited time-frame, i.e. ten days - 30 days etc. Write a letter to the REALTOR and to the Broker of the company for whom he or she works saying that you are dissatisfied with their performance and no longer want them to represent you.





    Keep a copy of that letter in case the agent or the brokerage try to claim commissions when you do locate a property. Find a good agent to help you but if you do sign an agreement keep it within short time frames.





    Now because this is a buyer's market I am surprised that even with an inexperienced agent you haven't found something. My experience is that someone who can't find a house is someone who is looking in a price range for which they don't qualify or who expects the impossible. I hope that doesn't describe you.





    Whoever you work with will give you professional advise. You will need to make a conscious decision to listen to them and take their advice. You usually can't find everything you want at the price you want to pay.

    A warrantless Home search: Was this Legal?

    I wasn't there at the time, but my friend had a party while his parents were out of town and he ended up getting busted by the cops. Of course there was drinking (mostly underage) and drugging (no age-limit [still Illegal no matter what]), which is a key factor in the bust. My friend told me the reason the cops ended up there is because some 14yr. old girl who was at the party told her sister about it and her sister told their mom about it and their Mom called the Cops. The Cops came to My friends house and knocked on the door. When my friend came to the door he asked who it was and they told him who they were and instructed him to open the door, but I think he told them no (or something like that) and a police officer threatened to break the door down if he didn't. There was no warrant for the search and we're positive it wasn't the neighbors who called about a noise complaint. Everyone was arrested for underage drinking.     There was nothing illegal about the home search. A warrant is NOT required when there is probable cause to believe something illegal is going on or that someone is in danger. When the police received the tip there was underage drinking going on at the house, the police went to check it out. When your friend refused to answer, that gave the police additional probable cause to believe illegal activity was going on. It doesn't matter if the neighbors called about a noise complaint or not. Someone contacted the police about an underage drinking party. Everyone was lawfully arrested and the police lawfully entered the home. There is nothing unlawful about what you stated.     At no point in your story did you mention that the officer DID search the house. All he did was come to the home, knock on the door, arrest people for underage drinking. Officer cannot search the home without a warrant, but they can take what is seen in plain view, or in your trash. Unless there is more that you didnt mention, officer didnt do anything wrong.
    a cop with reasonable belief (ie a complaint) about illegal activities happening on a property can enter the property and arrest anyone they see engaging illegal activities.





    Evidence of course has to be in plain view (ie they can't look under the couch)

If they have reason to believe that someone is in danger i.e. kids getting drunk and unsupervised, possible drugs, etc., especially when the call they recieved was backed up by more than likely noise/ party!!! Also, not sure what state you are in, BUT in Illinois they are really hitting the parents hard. Home or not!!! It was on the news. They can be charged for numerous things while on vacation! Parents are advised to have a neighbor or someone watch the house even when they leave adults (not yet 21 though) at the home. Missouri has been doing this but I think we are going to see it alot more often. I believe that it is better that the underage drinkers got arrested than the innocent parents!!! The kids will be just fine and hopefully learn a lesson. If they are going to drink, do it discretely or not at all (even better) but we know that is not going to happen!
    Just remember, they can do whatever they want!!!!!!!!! This happened to my family last night. My daughter answered the door, while I was the bedroom and my husband was asleep. We have 2 daughters and they were both home. Guess who? It was the Drug Task Force. Why? I haven't a clue. They ask my daughter a few questions. I could hear her talking to someone. I went to the door and the officer ask me to step outside. I did. He ask about some illegal activety. I told him he had the wrong house. He ask me to show him around our buildings outside. I did. He then ask to look in this particural shed. I let him. To my surprise the garage door was open. We never keep it open. He went in and didn't even ask for the light. I turned the light on and low and behold on a chair was backpack he opened up and found a lab. He had no search warrant, and I was willing to show it to him. We are not involved in this. He called for back up. I had to stay in the building with him. After making his notes, he let me go in my house. Being a lawyer, he knew he made several mistakes. Now the games will begin! What I am trying to tell you, you can either not answer the door. They might try to kick it in, if they feel they just cause. I mean a big cause. If you open it up to them, they can do whatever they want. They can arrest whoever they want. Don't believe INNOCENT UNTL PROVEN GUILTY. It's GUILTY UNTIL PROVEN INNOCIENT.

    The Supreme Court ruled that evidence found during a ';no-knock'; search of a home can be used in court. Here is what I am wondering, if the authorities enter somebodies home without announcing their presence, what happens if the person shoots at them?     No-Knock only applies under certain circumstances (cops likely to encounter gunfire, possibility loss of evidence: drugs flushed down the toliet, ect.)





    However no-knock does not mean no-announce. The police should always announce that it is the ';police'; ect. when coming through your front door even when a no-knock warrant applies.





    Further, technically it would not be self defense to shoot someone coming into your home until they make it all the way inside and present themself with a weapon likely cause you serious injury or death.Question about Supreme Court ruling on ';no-knock'; home search...?
    If they announce, if they do not knock they could startle the inhabitants and if an injury or homicide resulted, it would be justifiable.

    The ruling did not address that particular point, but a previous ruling from 1948 suggests that a resultant homicide might be considered justifiable.

    I don't know, but yea, I just saw a few ads in the rental section for these foreclosures that help people avoid defaulting on home loans. Sounds smart and nice. I just spoke with a representative from RT and since he wanted $199 %26amp; my credit card in order to set up a user name %26amp; password, I decided to take some time to check them out. Don't want to walk into any trouble. Anyways, the guy became pushy and rude and that made me even more concerned that this group may be a scam. They do have a web-site, which means nothing.

    You can refuse to admit them and if they are persistant, your refusal will cause them to force their way in. Then you may have grounds for dismissal of any ';evidence'; found. Being a minor has nothing to do with it if you live alone.





    However, if they have any suspicions under the PATRIOT Act, (google it. read it) they can just wait until you are absent from the premesis and break in then, searching all they want, and there's not a damn thing you can do about it. They don't even have to tell you they did it. If they did tell you and told you not to tell anybody else about it, you could go to jail for opening your mouth.
    Some places may have different laws but generally they are not allowed inside without a warrant if you don't let them in and they have no cause to enter without one such as - they can see illegal activities from where they are or believe you to be harboring a fugitive. Without a parent, guardian, or legal representative present, you'd be at a disadvantage seeing as how some minors (from my personal experiences working with them) have been questioned, held, searched, or arrested without Miranda or being told what they are charged with while the police tell them they have not the rights of adults. Are you an emancipated minor? Either way, I would definitely look into it for answers. Don't forget to check local law.

    Does anyone have any insight as to why the lister would say ';Special Details'; in the description? Could that mean something like a murder or a violent crime happen there? Or perhaps it's something like the house has been in a fire and restored?

    You assume such a ';book'; exists, and that it's not just legal theory that's taught in the academy and then continued through ongoing refresher training. I don't think you can safely make that assumption, depending on exactly what you're looking for.





    Also, without knowing what state you're in, it's difficult to give you an answer. No state can allow for less restrictive search and seizure standards than the Constitution permits, but any state can make more stringent standards.





    If you're in California, you can purchase a copy of the Peace Officer's Legal Sourcebook, published by the California Attorney General's Office. A link to it is below:
