I'm a minor as of now, currently living alone, and have a few questions. If the police were to come to my door without any kind of warrant, can I refuse to admit them, or does my status as a minor revoke that ability?Minor in need of information concerning police and home searches.?
Yes you do not have to let the cops in. The cops will twist their words to make you think that they can come in to your home but stand your ground and tell the cops they will have to get a search warrant .Minor in need of information concerning police and home searches.?
You can refuse to admit them and if they are persistant, your refusal will cause them to force their way in. Then you may have grounds for dismissal of any ';evidence'; found. Being a minor has nothing to do with it if you live alone.
However, if they have any suspicions under the PATRIOT Act, (google it. read it) they can just wait until you are absent from the premesis and break in then, searching all they want, and there's not a damn thing you can do about it. They don't even have to tell you they did it. If they did tell you and told you not to tell anybody else about it, you could go to jail for opening your mouth.
Some places may have different laws but generally they are not allowed inside without a warrant if you don't let them in and they have no cause to enter without one such as - they can see illegal activities from where they are or believe you to be harboring a fugitive. Without a parent, guardian, or legal representative present, you'd be at a disadvantage seeing as how some minors (from my personal experiences working with them) have been questioned, held, searched, or arrested without Miranda or being told what they are charged with while the police tell them they have not the rights of adults. Are you an emancipated minor? Either way, I would definitely look into it for answers. Don't forget to check local law.
